SMS / Text Messaging Terms of Service

These SMS / Text Messaging Terms of Service ("SMS Terms") govern your participation in the Rosella Brokerage text messaging program (the "Program"). By opting in to the Program, you agree to these SMS Terms and to our Privacy Policy. If you do not agree, do not opt in, or text STOP at any time to cancel.

These SMS Terms are in addition to, and do not replace, the Rosella Brokerage Terms of Service and Privacy Policy.


1. Program Sponsor

The Program is operated by Rosella Services, Inc., doing business as Rosella Brokerage ("Rosella," "we," "us," or "our"), a commercial insurance brokerage (NPN 22136964).

2. Program Description

The Program sends SMS and/or MMS messages related to your relationship with Rosella Brokerage. Messages may include, without limitation:

  • Quote follow-ups and policy proposal updates
  • Application status, underwriting requests, and document requests
  • Policy issuance, renewal, and cancellation notices
  • Premium payment reminders and billing notifications
  • Claims status updates and claims communications
  • Certificate of insurance ("COI") delivery and requests
  • Appointment scheduling and reminders with your broker
  • Customer service responses to inbound inquiries
  • Other transactional and account-related notifications you have requested

The Program is intended for current and prospective Rosella Brokerage clients and authorized representatives only.

3. How to Opt In

You may enroll in the Program by:

  • Submitting a web form on a Rosella Brokerage website that includes SMS consent language;
  • Providing your mobile number and consenting to receive text messages on a paper or electronic application or service form;
  • Texting QUOTE (or another Program keyword we publish) to a Rosella Brokerage messaging number provided to you at the point of opt-in; or
  • Verbally consenting and confirming via written or electronic record while speaking with a Rosella Brokerage representative.

By opting in, you certify that you are at least 18 years of age, that the mobile number you provided belongs to you (or that you are authorized to enroll it), and that you consent to receive messages at that number from Rosella Brokerage and our service providers using an automated system.

Consent to receive marketing or promotional text messages is not a condition of purchasing any goods or services from Rosella Brokerage.

4. Message Frequency

Message frequency varies based on your interactions with Rosella Brokerage. You may receive up to approximately 10 messages per month per active matter (such as a quote, application, renewal, or claim), with frequency typically increasing during active quoting, renewal, or claims activity.

5. Message and Data Rates

Message and data rates may apply. Rosella Brokerage does not charge a fee for sending or receiving Program messages, but your wireless carrier's standard message and data rates apply to each message sent or received in connection with the Program. Check your mobile plan and contact your wireless provider for details.

6. How to Cancel (Opt Out)

You can cancel the Program at any time by replying STOPENDCANCELUNSUBSCRIBE, or QUIT to any Rosella Brokerage text message. Opt-out requests are processed per number, so if you have opted in to more than one Rosella Brokerage messaging campaign, send STOP to each number from which you wish to stop receiving messages.

After you send the opt-out message, we will send you a confirmation message acknowledging that you have been unsubscribed and will not receive additional Program messages. You may continue to receive messages for a short period while your request is processed.

If you opt out and then later wish to resume the Program, simply sign up again as described in Section 3. Opting out of the Program does not opt you out of unrelated communications, including transactional or legally required communications outside the Program.

8. Supported Carriers

The Program is available on most major U.S. wireless carriers, including (but not limited to): AT&T, T-Mobile, Verizon Wireless, U.S. Cellular, Cricket Wireless, Boost Mobile, Metro by T-Mobile, Google Fi, Mint Mobile, C-Spire, and Cellcom, as well as other carriers identified at the time of the Program's launch.

Carriers are not liable for delayed or undelivered messages. T-Mobile is not liable for delayed or undelivered messages. Carrier participation is subject to change without notice, and the Program may not be available on all carriers at all times.

9. Your Mobile Number

You agree to notify Rosella Brokerage promptly if you change, deactivate, or transfer the mobile number associated with your enrollment. Failure to notify us may result in messages being sent to a number that is no longer yours.

You represent and warrant that the mobile number you provided is your own or that you are authorized to enroll it in the Program, and you agree to indemnify Rosella Brokerage for any claims arising from your enrollment of a number you were not authorized to enroll.

10. Privacy

Your privacy is important to us. Information collected through the Program is handled in accordance with our Privacy Policy.

Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors that support the Program (for example, our SMS messaging platform provider) is permitted. All other categories of use and sharing are described in our Privacy Policy.

11. No Warranty; Limitation of Liability

The Program is provided on an "as-is" and "as-available" basis. To the maximum extent permitted by law, Rosella Brokerage disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Rosella Brokerage is not responsible for any delays in the receipt of, or for any failure to deliver, any messages, as delivery is subject to effective transmission by your wireless carrier and is outside of our control.

To the maximum extent permitted by law, in no event shall Rosella Brokerage, its affiliates, or its service providers be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the Program.

12. Changes to These SMS Terms

We may modify, suspend, or terminate the Program or these SMS Terms at any time, with or without notice, at our sole discretion. Continued participation in the Program after a change becomes effective constitutes your acceptance of the change. The "Last updated" date at the top of these SMS Terms reflects the most recent revision.

13. Governing Law; Dispute Resolution

These SMS Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to the Program or these SMS Terms will be resolved as set forth in the Rosella Brokerage Terms of Service.
